About Us

The law firm that is now known as Foley McIntosh Frey & Claytor, Professional Corporation, was commenced in 1949 by Robert J. Foley in a small storefront office in Albany, California.  Mr. Foley had obtained his undergraduate degree from the University of Notre Dame as a United States Navy officer training cadet.  After graduation, Mr. Foley served in the United States Navy with distinction in the South Pacific, and after completion of his military service, Mr. Foley obtained his Juris Doctor degree from Stanford University School of Law.

Within a short time Mr. Foley’s practice outgrew the small storefront office, and he therefore relocated to a two story office building located at 1225 Solano Avenue, Albany, California, which was built by Mr. Foley and a Certified Public Account, Walter Sears.  The firm’s main offices were located at this location until 1995, when the firm moved to the present location in Lafayette, California. 

Mr. Foley maintained a solo practice until about 1960, when he formed a law partnership with Lawrence Saylor and James Doubt, under the name, Foley, Saylor & Doubt.  In 1967, the firm was reorganized as Foley, McIntosh & Foley, Professional Corporation, with the principals being Mr. Foley, Thomas J. McIntosh, and William R. Foley, Mr. Foley’s nephew.

Since 1967, the number of firm attorneys has varied from time to time, generally within the range of three (3) to eight (8) attorneys. 

During the years, the firm has had a unique and significant clientele.  Corporate clients have included Fry’s Food Stores, Southern Pacific Railroad, The Flecto Company, Inc., Lo-Ray’s Food Stores, Fleming Companies, Inc., Noll Manufacturing Co., Independent Quality Care, Inc./Foresight Management Services, LLC, and currently includes Fry’s Electronics, Inc., Andronico’s Markets, Inc., Old Republic Home Protection Company, Inc., Pacific Coast Sales & Service, Inc., and Western State Design, Inc., among others.

In 1994, Robert J. Foley retired.  Thereafter, the name of the firm was changed to Foley McIntosh Frey & Claytor, Professional Corporation.  This was done to formalize the retirement of Mr. Foley, and to give recognition to the long participation of James D. Claytor and David L. Frey, as shareholders of the firm. 
In 2004, Mr. McIntosh withdrew as a shareholder in the firm.  He continues to maintain office space in the firm’s offices, and is associated with the firm in an Of Counsel capacity.

The firm’s shareholders currently are William R. Foley, who has been with the firm since 1969, James D. Claytor, who has been with the firm since 1980, David L. Frey, who has been with the firm since 1985, and D. Christian Claytor, who has been with the firm since 2004.  Christian Claytor is James Claytor’s son.
